1. Website use

You may use this website only for lawful purposes and in accordance with these Terms. You agree not to interfere with the operation of the site, attempt unauthorized access, scrape or harvest data, submit false or another person's information, or use the site to transmit unsolicited communications.

2. Our role

Nearby Window Pros is a lead-generation and contractor-matching service. We are not a window contractor, installer, manufacturer or dealer, and we do not perform window replacement, installation, glass or construction services.

When you submit a request, we may transmit the information you provide to one or more independent third-party service providers, contractors, installers, dealers, buyers or marketing partners so they may contact you about your project. That transmission is the extent of our service.

3. Independent providers

Service providers are independent businesses. Unless expressly stated otherwise in writing, no agency, partnership, joint venture, employment or franchise relationship exists between us and any provider.

Any agreement you enter into for window products or services is solely between you and that provider. We are not a party to that agreement and are not responsible for provider pricing, terms, scheduling, warranties, workmanship, licensing, insurance or conduct.

4. Estimates and service availability

Any estimate, quote, figure, product recommendation or timeline you receive is provided by the service provider, not by us. Estimates are not offers by us and may change following an on-site inspection or further review.

Matching depends on provider coverage in your area, provider availability and the details of your request. We do not guarantee that any provider will be available, will contact you or will accept your project.

5. Communication consent

By submitting a request and checking the consent box, you agree to be contacted as described in that disclosure and in our Privacy Policy, including by automated means, prerecorded or artificial voice, SMS text message, telephone and email. Consent is not a condition of purchase, and you may revoke consent as described in the Privacy Policy.

6. Accuracy of your information

You represent that the information you submit is accurate, complete and your own, and that you are authorized to provide the telephone number and email address given. Submitting another person's information without permission is a breach of these Terms.

7. Intellectual property

All content on this site, including text, layout, graphics, illustrations, interface design, three-dimensional and animated assets, source code and the Nearby Window Pros name and marks, is owned by TRAKCIA or its licensors and is protected by intellectual-property laws. You may not copy, reproduce, distribute, modify or create derivative works without prior written permission.

8. Disclaimer of warranties

The site and matching service are provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, secure or error-free.

9. Limitation of liability

To the maximum extent permitted by law, neither we nor our affiliates will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data or goodwill, arising out of or relating to the site, the matching service, or any work performed or not performed by a service provider.

10. Indemnification

You agree to indemnify and hold harmless TRAKCIA, its officers, directors, employees and agents from claims, demands, losses and expenses arising from your use of the site, your breach of these Terms, or your dealings with any service provider.

11. Changes to these Terms

We may revise these Terms at any time. The date above shows when they were last updated. Continued use of the site after changes take effect constitutes acceptance of the revised Terms.
